Board staff said the parties submitted an agreement in advance of the hearing that included conditions to make the permit code-compliant. The permit at issue (202406184755) would authorize adding one air-conditioning unit on a mid roof; staff noted the new unit was described as weighing approximately 300 pounds.
During the hearing, the board heard brief public comment from Georgia Shudisch, who urged the panel to consider objective standards for siting rooftop equipment given a prior enforcement matter involving roof decks and earlier direction that similar equipment be placed in yards. Commissioners then moved to grant the appeal and issue the permit as revised, with the written decision to list all conditions submitted in the agreement.
President Lopez and the other members voted in favor; the motion carried 5-0. Board staff said they would issue the written decision the next day if the permit holder and appellant agreed to waive rehearing rights.
The board took no separate action on enforcement or code changes; commissioners said the written decision will enumerate the agreed conditions and compliance findings.
