Board continues Dorcas Way encroachment appeal to Oct. 6 as neighbors and permit holder negotiate access

The Board of Appeals continued an appeal concerning 120 Dorcas Way to Oct. 6 after neighbors and the permit-holder’s representative agreed to meet and attempt a resolution. The appeal concerns permit number 202107194604, issued July 19 for roof, gutter, siding and light-well work, and a neighbor’s survey that shows portions of the gutter and downspout extending approximately 5 and 3 inches onto the neighboring property.
Appellant Tim Louie, represented by attorney Madeline Sachs, said the work was performed by an unlicensed contractor and encroached onto his property; she asked the board to revoke the permit. Sachs said the permit’s scope did not authorize work that crosses the property line and that the permit holder had not complied with the notice of violation.
Mr. Coleman, agent for the permit holder, said the work addressed immediate water intrusion and safety concerns and said he was willing to remove the encroaching gutter and downspout and to coordinate with the neighbor. DBI Deputy Director Joe Duffy noted that work must occur within property lines, acknowledged the complication of access to perform the repair, and offered departmental assistance to resolve technical issues.
Commissioner Anne Lazarus moved to continue the item to Oct. 6 to allow the parties to meet and confer and to file a one-page position statement by the Thursday before the continued hearing; the motion carried 5–0. DBI said it would be available to help facilitate resolution and to advise on any necessary permits once the parties agree on access or remediation steps.
