Public protests indefinite continuance of medical cannabis dispensary; staff cites code chart technicality

Several members of the public urged the Planning Commission not to indefinitely continue a Conditional Use Authorization involving a proposed medical cannabis dispensary, arguing the project was being singled out while comparable dispensaries had not faced the same procedural treatment.
Paul Hansberry told the commission he had researched the planning code and believed the code’s tables and prior resolutions required a discretionary review for dispensaries; he asked why the project was being targeted when other dispensaries had proceeded. "Why is this dispensary being targeted for this?" he asked, citing examples of other dispensaries that were not subjected to the same review.
Susan Tibone, a former civics teacher, echoed those concerns and said the proposed dispensary would serve an area without cannabis access. She said the indefinite continuance appeared politically motivated and urged staff and the commission to reconsider differential treatment.
Planning staff responded that the ordinance governing the Sunset Neighborhood Commercial Districts included a small, technical provision: uses not listed as "active commercial uses" under certain chart references are treated as conditional uses, which in this case makes a medical cannabis dispensary a CU rather than the more common "doctor" pathway used elsewhere. Staff said department recommendations to clarify the chart had not been adopted in the ordinance’s final language, producing an unexpectedly convoluted result.
The commission moved to continue the listed items to specified dates; Item 7 (2139 Terrevall Street) was set for indefinite continuance. Commissioners indicated they would follow up on the public questions and asked staff to provide the legislative text and clarification to the commission and public.
What’s next: Staff will share the pertinent ordinance excerpts and provide clarification on the legal basis for conditional-use treatment in the affected neighborhood commercial district. The commission did not take final action on the dispensary project at this meeting.
