The San Francisco Board of Appeals on a unanimous 5–0 vote granted a rear‑yard variance for the property at 135 Third Avenue, allowing a one‑story horizontal expansion and a roof deck after parties presented revised plans and draft findings.
Scott Sanchez of the Planning Department told the board the existing building wall extends 1 foot, 8 inches into the required 54‑foot rear yard and the existing deck encroaches about 17 feet. Sanchez said the revised design would extend a total of 12 feet to the required rear yard line (about 10 feet, 4 inches beyond the existing rear wall), would be one story and set back 5 feet from each side, and was presented as a compromise that would be comparable to a code‑compliant option.
The project team and adjacent property owners submitted letters of support, and the appellant’s architect said the proposed deck footprint is smaller than the existing deck and would increase usable open space. Commissioner Anne Lazarus moved to adopt the revised plans dated Feb. 25, 2020, and the draft variance findings and to grant the variance on the basis that the project would become code‑compliant and satisfy the parties. The motion carried 5–0.
President Daryl Honda noted that if the parties waived rehearing the board could issue the decision the following day; the parties agreed and asked staff to prepare the decision promptly.
