Deputy Director Joe Duffy told commissioners he walked the structure and found the deck and stair landings generally sound though some landings and posts need repair; he recommended a scope that would replace fire‑egress stairs in kind, remove the portion of the third‑floor deck that protrudes beyond the north property line, repair decking (less than 50% replacement), install mechanical fasteners as needed and replace guardrails and handrails.
Planning staff supported the approach, saying repair rather than full replacement avoids triggering a variance. The board adopted a motion to grant the appeal and issue a permit conditioned on revised plans reflecting DBI’s recommendations; the permit holder’s engineer and HOA agreed to submit plans as required. The motion passed 4–0.
Next steps: the permit holder must submit revised plans incorporating DBI’s scope for review and approval; DBI will inspect and issue a special‑conditions permit on final sign‑off.
