The project sponsor and architect responded with site plans and photos showing the deck set back from the neighbor's window and argued that access to the rear hillside is common to nearby properties.
After questioning and review of the evidence, commissioners found there were no extraordinary circumstances warranting Doctor and approved the project as proposed by a unanimous 7–0 vote. Commissioners noted the location and topography reduce the likelihood the deck would materially impair privacy or create an undue security risk.
