In a de novo review on Dec. 4, the San Francisco Board of Appeals granted the appeal by Mark Kang (represented by Amy Lee) of the Planning Commission’s denial of a permit for repairs to a solarium roof and a modest deck extension at 610 El Camino Del Mar.
Amy Lee told the board the project had been reviewed and approved by planning staff, was code‑compliant and that the Planning Commission had improperly relied on a private 2011 agreement between neighboring property owners to deny the permit. Planning staff representative Scott Sanchez confirmed the planning review found the project compliant with the Residential Design Guidelines, but noted the Planning Commission had expressed concerns about mid‑block open space impacts and privacy.
Commissioner Daryl Honda moved to grant the appeal on the grounds the project met code requirements; the board voted 5–0 to overturn the Planning Commission denial and issue the permit. President Rick Swig clarified that granting the appeal constitutes the project approval for CEQA purposes pursuant to San Francisco Administrative Code.
