The Board of Appeals denied a jurisdiction request from Mark Bruno challenging the issuance of an alteration permit for Unit 2 at 15 Nobles Alley. Bruno and other tenants raised concerns about lead‑paint notifications and alleged the city failed to provide required notice after earlier plan errors; they argued the project may disturb lead paint and the tenants lacked proper notice.
Department of Building Inspection inspector Joe Duffy and permit holder counsel Leo LaRocca told the board the 2019 permit had been routed through DBI divisions (plumbing, code enforcement, housing inspection and plan check) and that DBI does not require building‑permit tenant notices for this minor remodel category; DBI said the contractor/owner is responsible for posting lead‑abatement notices and that tenants could file complaints with DBI’s housing inspection services if required notices were missing. Duffy confirmed the property had an earlier notice of violation (02/27/2018) for expired permits but said the current permit appeared properly issued and that work on Unit 2 was substantially complete.
Vice President Anne Lazarus moved to deny the jurisdiction request on the basis the city did not cause the requester to be late in filing an appeal; the motion carried 4‑0. The board recorded that DBI would continue to respond to tenant complaints and that the record includes the prior NOV and a list of older expired permits on the building.
