Board continues Hampshire Flats renovation appeal after DBI identifies NOVs and paused work

Tenants and counsel told the board that construction practices at the Hampshire Flats building (units 821–829 Hampshire St.) have produced debris, security failures (an open tradesman door and claimed theft), scaffolding left in place, and multiple Notices of Violation. Appellant Terry Castro and counsel Michael Zitani said work went beyond permitted scope and argued the owner may be seeking an Ellis Act strategy that increases incentives to empty the building.
Respondent counsel James Quadra said the owner and contractor have made mitigation offers — work‑hour limits, extra cleanup and security, and written assurances not to enter the occupied unit — and asked that the permit be upheld. DBI Inspector Joe Duffy reported several NOVs, a suspended permit, evidence that structural members were installed without approved plans, and that the contractor had filed a permit to comply that remained to be issued. Duffy said the project appears to be on pause where the NOV applies.
After questioning and public comment, Vice President Lazarus moved to continue the matter to Oct. 16 so DBI can inspect the property and report on the status of permits and outstanding compliance issues; the board voted 5–0 to continue.
