On Aug. 8 the San Francisco Board of Appeals denied an appeal challenging a revision to a shoring/excavation permit for 162/162a Grandview Avenue and upheld the permit as properly issued.
Appellant Norman Hertrich told the board he believes title and estate litigation leave ownership unsettled and asked the board to preserve the status quo until courts resolve the dispute. "If I am the owner then I want the property to remain as it was when my father died," Hertrich said.
Jim Zack, the project architect and contractor, explained the revision under appeal was a minor change to an issued shoring permit and described extensive geotechnical, peer-review and plan-check work performed by DBI. Zack said the appellant had not presented code issues or evidence that would call the permit into question and characterized the appeal as motivated by long-running estate litigation rather than construction or permit defects.
Planning staff supported the permit, and DBI representatives noted the agency checks ownership via assessor records when necessary. Commissioner Lazarus moved to deny the appeal; the board voted to uphold the permit.
