The permit holder said plans had been updated after meetings with plan check staff and that structural and sprinkler permits would follow. Neighbors and an adjacent property owner argued the window openings appear to conflict with California and San Francisco building code limits on openings near property lines and that the local equivalency (AB009) requirements, including declarations of use limitations and demonstration of practical difficulties, had not been documented fully.
Board members flagged missing technical details—specifically the percentage of allowable openings and Inspector Joe Duffy’s input on whether the current plans meet code—and directed that both parties may submit three‑page briefs addressing how the plans conform to AB009, San Francisco building code equivalencies and exemptions from CBC. The matter was set for continuance to August 15 so Inspector Duffy can attend and parties can supplement the record.
