The Planning Commission in late evening action approved key entitlements for the 181 Fremont project, a 52‑story tower adjacent to the new Transbay Transit Center that is proposed at the plan‑level 700‑foot height cap.
Planning staff recommended the exceptions the project seeks under Planning Code Section 309, and presented an analysis showing the proposed new shadow on Union Square would be extremely limited (about five minutes on two days per year) and within the district’s shadow allowance. "Staff believes that the requested exceptions are warranted and meet the criteria of the code," the staff summary said. Commissioners voted separately to allocate the project’s office square footage under the city’s office‑allocation program and to approve the requested exceptions. The commission approved the net‑new shadow allocation on a 5–1 vote; other required allocations and Section 309 determinations passed by majority votes later in the meeting.
Project manager Steve Shanks told the commission the development includes roughly 404,000 square feet of office, 74 residential units above an architectural break, retail that will connect to the planned rooftop Transit Center park and a pedestrian bridge to that park. Sponsor representatives noted the project’s projected contributions to transbay park and transit infrastructure from new district fees and impact payments.
Commissioners asked for and received commitments on peer review, coordination of foundation design adjacent to the train box, and conditions tying some entitlements to project performance. The commission set a five‑year entitlement/performance period for the Section 309 exceptions to reflect the project’s technical complexity and the number of interagency agreements required.
