The Board of Appeals continued consideration of a jurisdiction request for 278 Monticello Street on Jan. 10 to Feb. 28, 2018, to allow the Planning Department and the requester to meet and attempt a settlement. The property owner (Andy Chan) told the board that more than $500,000 had been spent on construction and that permits previously issued were later suspended; he said language and communication challenges had impeded his ability to respond earlier.
Planning staff (Scott Sanchez) described two enforcement streams: DBI fines that were paid ($1,118.76) and separate planning penalties that continued to accrue from Dec. 26, 2015 until abatement. DBI inspector Joe Duffy said the original permit had been issued in error and subsequently rescinded; suspended permits remain unresolved. Commissioners expressed concern about the size of accrued penalties and supported allowing Planning and the requester time to negotiate a mutually acceptable resolution. A motion to continue the matter to Feb. 28 carried (vote recorded as 3–2).
