When the Clay Street appeal (16‑168) first came before the board, parties signaled they had reached an accommodation: the project sponsor agreed to remove a proposed spiral rear stair and to slope a flat roof and raise an adjacent property‑line window so the changes preserve light to a neighboring unit. Scott Sanchez, the zoning administrator, said more specific site plans would be required for the special‑conditions permit but that the overhead drawings provided that day were sufficient to document the agreement.
Neighbors testified about privacy and light impacts, and a public commenter described concerns about noise and the loss of large trees. The project sponsor’s counsel presented dated sketches showing the stair removal and a mansard/roof detail to keep the bottom of the adjacent window above a pitched roof.
Commissioners framed the board action as incorporating the parties’ agreement into the permit record. A motion to grant the appeal and condition the site permit on the revisions submitted that day carried unanimously, 5–0. The board instructed staff to ensure the revised plans are dated and filed as the controlling record for the special‑conditions permit.
