Board conditions vinyl replacement windows permit on compliant replacements by end of 2023

On Sept. 27 the San Francisco Board of Appeals addressed an appeal concerning replacement of street‑facing windows at 440 Holiday Avenue. The property owner said she relied on departmental brochures and that replacing the aluminum windows with vinyl resolved leaks and mold in the lower unit. Planning and DBI staff said the windows were installed without a required permit and the replacements do not meet Planning Department window‑replacement standards for a street‑facing façade on a potentially historic resource.
Inspector Joe Duffy said DBI issued a notice of violation after a complaint and that the corrective action would be to obtain a building permit and Planning approval; he also noted the department frequently gives timeframes for compliance when owners have financial hardship. Planning’s Scott Sanchez said the installed vinyl windows do not meet the residential design guidelines for visible street‑facing openings.
Board members discussed precedent, enforcement options and financial hardship. The board voted to grant the appeal conditionally: the permit must be revised to reflect replacement windows that meet the Planning Department’s residential design guidelines, and the replacements must be installed by Dec. 31, 2023. The motion carried with recorded ayes from Vice President Fung, Commissioner Lazarus and President Honda.
