Board continues appeals over 407A Thirtieth Street siding permit amid plan-set discrepancies

The Board of Appeals continued two appeals challenging work at 407A Thirtieth Street after appellants raised discrepancies between plan sets used by Planning and the set of drawings recorded by the Department of Building Inspection.
Appellants’ counsel (Ryan Patterson) and neighbors (John Sullivan, Kevin Dwyer) said Planning had reviewed a larger, six-sheet set for discretionary review while DBI’s issued job set reflected only two sheets, omitting a site plan and proposed-work sheet that appellants say is necessary to assess required fire-wall ratings and other code requirements. Their expert told the board the missing sheet could omit details that trigger a 1-hour fire-wall requirement based on proximity to the property line.
DBI and Planning representatives acknowledged the record is confusing and that DBI’s permit-tracking system shows two sheets were stamped for the issued permit; DBI said it would retrieve and verify the approved job set. The permit holder’s counsel said the siding permit was an over-the-counter correction to an NOV and argued the broader issues had been litigated previously.
Given unresolved questions about the plan set and whether required details were included in DBI’s issued job set, the board continued the appeals to Aug. 23, 2017 and directed DBI to verify and report whether the permit job set contains the required drawings for the siding replacement and related work.
Next steps: DBI to verify job/permit plan set by Aug. 23, 2017; board will reconvene the appeal then.
