Board denies appeal over canceled Boccona Street permit; applicants must reapply

The Board of Appeals on July 12 denied an appeal from Mark Montserrat and project sponsor Brian Knock challenging the Planning Department’s cancellation of a building and variance application for 170 Boccona Street.
The homeowner and architect said the permit had been filed in 2013 and asked the board to reinstate the application after a series of staffing changes left the file idle. Planning’s Scott Sanchez explained staff had notified the project architect in December 2015 that revised plans were required and that after no responsive filings the department closed the case under its procedures; he said staff could not remand the file and that the administrative action effectively canceled the variance application.
The board found the department had followed its process and that the applicants’ remedy was to reapply; the board voted to deny the appeal. Commissioners noted the procedural history and emphasized applicants could seek new review or consult finance staff about any remaining credits for prior payments.
