Appeal 17‑046 (AP Lehi Exempt Trust v. Zoning Administrator) was granted by the Board of Appeals on May 31 after the parties reported newly discovered evidence indicating a grandfathered office use at 414 Brannon Street.
Dan Fratton, counsel for the property owner, told the board that additional records turned up the same information the zoning administrator had just discovered and that the NOV appeared to have been issued in error. Planning Department staff member Scott Sanchez confirmed the department’s retrospective classification determined the prior use should be considered an office for the purposes of grandfathering.
The board voted to grant the appeal and overturn the Notice of Violation on the basis of error, voting 5‑0 to resolve the matter in favor of the appellant.
The matter concluded without further conditions; planning staff said they would work with the appellant to document the grandfathered use.
