The Board of Appeals reviewed two jurisdiction requests tied to building permit 201502269477S for work at 2328–2330 Northpointe Street after neighbors said they did not receive timely or accurate permit notices.
Diana Mistrell told the board she was out of the country when notices were mailed and that the planning department’s mailing to adjacent neighbors failed to reach the Quinns. Scott Quinn described receiving a notice showing a December 5 date (postmark issues) and said the permit window had already expired. Planning Department staff (Scott Sanchez) and DBI Inspector Joe Duffy acknowledged errors in mailing and in the permit project description: the planning corrected discretionary action memo was issued the day before the hearing and the project sponsor was informed they would need to make changes to comply with the planning commission decision.
The board considered two jurisdictional requests (6A and 6B). After discussion, the board denied the first request (6A) and granted the second (6B), finding the department’s clerical errors justified reopening the appeal period for the granted requester. The grant gives the requester a five-day appeal window to file an appeal that will bring the full matter back before the board for a substantive hearing.
