On Sept. 21 the San Francisco Board of Appeals granted an appeal concerning the site permit for 5435 Anza Street and conditioned the permit so that the project description in the electronic permit record accurately reflects the plans approved by Planning and the Department of Building Inspection.
Neighbor Sandy Rorta told the board she had received a notice with what she described as a clerical error in the permit description — a description she said reflected an earlier plan that included a new third floor and rooftop penthouse. Rorta asked the board to ensure the record and the approved plans matched and to address foundation concerns given shared foundations and hillside conditions.
Applicant Amy Lee and Planning Department staff said the project had gone through discretionary review, that revised plans had been approved by the Planning Commission and that a mismatch existed between the approved plans and the description carried in the permit-tracking 'pink form' used at intake. DBI inspector Bernie Curran said structural details are finalized later in the building-permit process and that an administrative permit could correct the project description.
Commissioner Lazarus moved to grant the appeal and condition the permit so the scope of work is changed to reflect the approved plans as stamped by DBI and Planning; the motion passed 4-0. The board noted the site permit stage does not yet authorize final structural means and methods, which will be reviewed in subsequent building‑permit submittals.
What’s next: The permit record will be revised to match the approved drawings, and structural and foundation details will be addressed through DBI building-permit review as required.
