Inspector Joseph Duffy of the Department of Building Inspection told the board he had reviewed permit-tracking records and a copy of the letter DBI sent to neighbors, and that DBI "sent out 11 letters" dated October 21, 2015, notifying nearby properties. Duffy also reported he conducted a site visit the morning of the hearing and found the structural work and inspections to be consistent with permit documents.
Vice President Frank Fung moved to deny the jurisdiction request on the ground that the city did not cause any late filing. Commissioners Anne Lazarus, Daryl Honda and Bobby Wilson voted aye; Commissioner Rick Swig was absent. The board’s clerk recorded the motion as carrying 4–0.
Why it matters: the board’s decision leaves the original Department of Building Inspection permit in place and confines the dispute to the normal permit-appeal process rather than expanding the board’s jurisdiction. The board said parties may pursue inspection and monitoring remedies through DBI during construction if neighbors raise concerns.
The board moved on to the next agenda item following the vote.
