Tom Tunney, counsel for the permit holder, told the Board the appellant had not presented new facts and that the prior ruling was supported by the record. Planning staff said they obtained the approved plans earlier the same day and that the plans showed the relevant changes discussed in the original hearing. The Board applied the strict standard for rehearing and voted to deny the request 4–0.
