Board continues Cresta Vista shoring appeal to Oct. 28, requires winterization plan

The Board of Appeals continued an appeal over temporary shoring and alleged improper excavation at 287 Cresta Vista to Oct. 28, 2015, after parties agreed to a schedule for technical submittals.
Appellants' counsel said excavation had been carried out in a manner inconsistent with the approved plans and that the site now contains six shoring piers that change the topography. Counsel and the structural engineer for the respondent, Rodrigo Santos, described a two-track approach: a short-term "winterization" and water-management set of drawings (to be submitted for peer review by Sept. 16) to stabilize the slope through the rainy season, and a separate revised shoring permit and SAC review addressing permanent shoring revisions by Sept. 30.
DBI inspector Joe Duffy confirmed emergency shoring permits and notices of violation exist and said the department will monitor inspections and enforce compliance. The board agreed to retain jurisdiction while the parties finalize technical plans; Commissioner Fung moved to continue to Oct. 28 to allow parties to complete the agreed submittals, and the motion carried 4–0.
DBI indicated it could issue a separate weatherization permit while the appeal remains pending and the parties can pursue revision or replacement permits as approved.
