Appellant Sue Hester argued staff relied on outdated transportation assumptions (census commute data from 1990) and that the shadow analysis under‑weighted impacts to the Mission Playground, which she described as the only outdoor public swimming pool in the city. Hester asked for a more focused shadow analysis consistent with Proposition K standards and urged the commission not to accept the PMND without additional study.
Planning staff and the project sponsor (Tim Brown / project team) responded that the PMND met the CEQA standard in the absence of substantial evidence of significant impacts. Staff noted the project replaces an underused service station and that transportation impacts were evaluated using established methodologies; the project also reduces curb cuts, provides car‑share spaces, and adds family‑sized units. Rec & Park staff reviewed the shadow analysis and concluded the incremental shadowing was not adverse or significant.
Commissioners discussed the technical issues and acknowledged the public interest in methodology improvements citywide; several commissioners supported broader work on transportation analysis methods. On the motions before the commission, members voted unanimously to uphold the PMND and then voted unanimously to approve the conditional use authorization with the findings and conditions in the staff packet.
What’s next: The project moves forward subject to the conditions of approval and standard permit filings. Commissioners and commenters asked planning staff to continue citywide review of transportation modeling practices for future CEQA work.
