Board Revokes Permits After Finding Plannings Block-Book Notice Procedure Not Followed

The Board granted an appeal and revoked a Department of Building Inspection demolition/alteration permit issued to remove an illegal ground-floor unit at 754-756 20th Avenue after Planning Department staff determined a required Block Book Notice (BBN) procedure had not been followed.
Appellant counsel argued the BBN filing dated Feb. 17, 2015 had not been processed into Plannings records in time for the department to effect required notice prior to permit issuance on Feb. 18; the Board reviewed a prior, similar case (1325 Kansas) where a procedural failure prompted unanimous relief. Plannings Scott Sanchez confirmed records ambiguity and said the permit appeared to have been issued in error without proper BBN notice. DBI said the unit was noncompliant and that physical-code hazards existed, but the Board focused on due process for notice and granted the appeal, revoking the permit (4-0). The Board directed refiling and full notification for any future application.
