Board upholds planter permit at 2655 Broderick, denies appellant’s appeal

The San Francisco Board of Appeals on Dec. 10 voted 4–0 to uphold a building permit for a structural planter at 2655 Broderick Street after hearing objections that the planter might impose lateral loads on an adjacent cantilevered wall.
Craig Nikitas, counsel for the permit holder, described engineering work to remove the existing planter, sink piers to bedrock and replace it with a reinforced concrete planter designed to avoid lateral loading on the neighboring wall. "This involves a 4 foot by 14 foot concrete planter that was meticulously overdesigned not to put a lateral load on Mr. Zaretsky's adjacent retaining wall," Nikitas said.
DBI staff and plan check engineers reviewed the plans and the permit was issued to resolve a prior notice of violation related to the planter retrofit process; DBI said two DBI plan check engineers reviewed the permit and the work addresses the notice of violation. After discussion the board moved to deny the appeal and uphold the permit; roll call was unanimous and the permit was upheld on the basis it was properly issued.
The board’s decision leaves DBI’s permit in place; commissioners said engineering review and the departmental plan‑check process supported the issuance.
