The San Francisco Board of Appeals voted 4-0 Oct. 15 to uphold a permit for a new rear deck and associated alterations at 179 Hammerton Avenue after the permit holder submitted revised plans and documentation from adjacent neighbors addressing a firewall concern.
The board found the revised plans satisfied the notice requirement and the Planning Department's review. "There are really two issues here, one regarding the firewall and whether or not it satisfied building code requirements," Scott Sanchez of the Planning Department told the board, and he said senior building inspector Joe Duffy had concluded the plans "look to meet the relevant building code requirements."
The permit holder's representative told the board the revised plans include firewalls on both sides of the proposed deck extending 9 feet from the building, a firewall rising 42 inches above the deck surface, hard siding painted to match the adjacent firewall, and a lattice screening agreement with a neighbor. The representative said a neighbor's letter of support was available but had arrived late because the neighbor was out of town.
Commissioner Frank Fung moved to grant the appeal insofar as the board would uphold the permit with the firewall modifications and a finding that the notice requirement had been met, citing documentation from adjacent neighbors and Planning Department input. The board discussed an inconsistency in a section detail that showed a railing rather than the firewall and directed that the section detail be clarified to show the firewall 42 inches above the deck. The board and staff also agreed to reference the October 9 submittal stamp for administrative clarity and asked the permit holder to correct and initial at least one copy of the plan set for the notice of decision.
On the motion to uphold the permit as revised, President Anne Lazarus, Commissioner Daryl Honda, Commissioner Bobby Wilson and Commissioner Frank Fung voted "Aye." Vice President Arcelya Hurtado was absent.
The board's decision upholds the permit subject to the clarified section detail and corrected plan documentation; staff will ensure the revised plans and the receipt date are properly recorded in the notice of decision.
