Board upholds permit for 2 Flood Avenue, finding code compliance

The Board of Appeals on May 14 upheld a building permit for a new three‑story single‑family home at 2 Flood Avenue, concluding the project met applicable code and residential-design guidance.

Appellant Jan Curry and nearby neighbors said the proposed 3‑story, 14‑hundred‑plus square‑foot structure was out of scale for the Sunnyside neighborhood and would block light and views. “This project is too large for our neighborhood,” Curry said, asking the Board to limit the building to two stories.

Project representatives including David Silverman and architect Gary Gee described an iterative design process, multiple neighborhood meetings and massing changes (notching and third‑floor setbacks) requested by planning staff and the residential design team. Zoning Administrator Scott Sanchez told the Board the third story is set back 12 feet from the main wall and the design meets code and customary planning practice for set‑back third floors in predominantly two‑story block faces.

Commissioners concluded that planning staff had adequately reviewed scale and setbacks and that the permit complied with code. The Board voted 5-0 to uphold the permit.
