The Planning Commission voted unanimously to allow a Chipotle restaurant to occupy the former Pizza Hut space at Lakeshore Plaza while modifying a decades‑old Condition 36 that narrowly limited the types of food businesses allowed in the center.
Staff explained Condition 36 — adopted as part of the site's original approvals — limited large fast‑food spaces to a short list of uses (pizza, certain bakeries/delis, candy/nuts, etc.). Center management said the restriction had become impractical and that the specific large space would otherwise sit vacant because many modern food concepts do not match the old list. Chipotle representatives described their operations, local outreach and community programs and said the chain already had successful locations in the city.
Commissioners debated whether relaxing the restriction would open the center to inappropriate fast‑food proliferation. Legal staff and planners explained that large fast‑food uses must still appear before the commission as conditional uses; commissioners chose a narrower path — they modified Condition 36 only for the particular second large fast‑food slot (the Pizza Hut space) so that a wider set of food concepts, including Chipotle, could be considered there while retaining tighter controls elsewhere in the plaza.
The motion passed unanimously, and the commission recorded the modification as limited to the second large fast‑food location in Lakeshore Plaza.
