Staff said wine sales had exceeded the permitted floor‑area threshold and the project did not meet the code's neighborhood‑serving grocery protections. The planner said the department had received letters both in support and in opposition and recommended disapproval to enable enforcement to resume.
The project sponsor, Salaki Abino, told the commission the business had lost money in earlier years and changed its operations to stay afloat; neighbors and merchants split in their views. Several commissioners said the project failed to follow the 2007 conditional‑use conditions and that enforcement was appropriate; Commissioner Antonini argued the owners had invested significant capital, the market mix in North Beach made a strict grocery improbable, and he opposed denying the project. The motion to disapprove the CU carried some votes but ultimately failed on a 3–1 vote (Commissioner Antonini voting no); subsequent attempts to continue were not seconded and died, leaving the status such that the conditional use was not approved at the meeting. The department will pursue enforcement and the applicant may return with a revised application.
