The San Francisco Board of Appeals on Jan. 29 upheld a permit for a roof deck at 530 Day Street after hearing privacy and alignment concerns from a neighbor.
Appellant Sulpizio Mariano said the proposed retractable skylight and parapet could affect privacy and that plan elements did not line up as shown. Rodrigo Santos, structural engineer for the permit holder, and planning staff said the roof-deck revision met planning and building-code requirements and was issued as a revision over the counter. Planning staff (Scott Sanchez) noted some discrepancies between roof and floor plans (retractable skylight alignment and a rear stair shown atop a retaining wall) and recommended the permit holder submit accurate as-built or revision plans to the building department for final review.
DBI and planning staff agreed the work appeared code-compliant; DBI said if as-built conditions differ from approved plans a revision permit would be required prior to final inspection. After discussion, the board voted to uphold the permit on the basis it is code-compliant and directed the departments to reconcile plan discrepancies and require revision permits if required; the motion passed 4–0.
The board’s decision affirms the permit but leaves open the administrative step of final-plan reconciliation and any building‑department revision permit that may be necessary before final sign-off.
