Appellants’ counsel Heidi Machin argued earlier rulings and de minimis standards should apply and requested ADA accommodations for driving requirements; she also said SFMTA improperly denied a transfer that would have allowed the medallion holder access to a different dispatch system. SFMTA enforcement manager Jarvis Murray and lead investigator Scott Leon presented a record of repeated failures: missing weekly company reports from 2010–2012, multiple inspections finding the business premise unattended, citations for non‑reporting, and evidence the medallion holder could not substantiate required driving or paratransit pickups in covered years.
Commission discussion focused on the medallion‑holder responsibility to ensure wheelchair pickups and to maintain company operations; commissioners voted to deny the appeal and uphold both revocations by a 5‑0 vote.
The board’s action removes the medallion and upholds the color‑scheme revocation; standard appeal and enforcement procedures apply.
