The San Francisco Board of Appeals on Jan. 15 denied a rehearing request for the permit approving an addition at 1532 Cole Street, concluding the appellant did not present new evidence or show manifest injustice.
Jace Levinson, principal at Jace Architecture, told the board the project improperly avoided neighborhood notice and argued Planning Code section 136(c)(26) should not be interpreted to allow habitable space where the department treated it as a garage. The permit holders’ architect said the project was reviewed with Planning staff and the design and elevations in the building permit are code‑compliant.
Zoning Administrator Scott Sanchez told the board the department reviewed the submittals and determined the permit complied with code; he said the rehearing standard requires either new information that could not have been presented earlier or a manifest injustice. After discussion, a motion to deny the rehearing request passed unanimously.
The board directed that a notice of decision and order be released. No further public comment was heard on the rehearing, and the matter was closed for the evening.
