Board denies rehearing for 350 Mission allocation; Hester’s request rejected 5–0

The San Francisco Board of Appeals on Dec. 11 denied an appellant’s request to rehear the Planning Commission’s approval of additional office allocation for 350 Mission Street.
Sue Hester, who sought a rehearing focused on the second office allocation (an extra six stories and 80,000 square feet), argued the board should revisit whether the Planning Commission’s action had been appropriate and questioned the sponsor’s participation in a fee‑deferral program. Project counsel Dan Fratton urged denial, saying the rehearing standard requires new evidence; he asked the board not to allow re‑litigation of issues previously considered.
Acting Zoning Administrator Corey Teague and other staff reviewed the discretionary and CEQA history of the project. After deliberation, the board voted 5–0 to deny the rehearing request and directed staff to release a notice of decision.
The rehearing denial preserves the Planning Commission and Board of Supervisors’ earlier actions on the project. The board’s action was procedural; it did not change permit status or physical conditions attached earlier in the entitlement process.
