The Board of Appeals resolved two appeals affecting 28 Bridal Avenue by upholding one permit as issued and upholding the related permit with a set of revised plans and specific conditions to address neighbor concerns.
Appellants complained the contractor had performed work beyond the original permits, encroached on a neighbor’s property, and filed incomplete plans that had been handed to opponents at the last minute. Appellant Jennifer Chung identified five points she said would resolve the dispute: set the deck back 3 feet from the neighbor’s property line; remove the Third‑Floor deck/door or otherwise prevent egress; split or otherwise address the shared rainwater leader; replace the fence between properties; and provide the foundation special‑inspection report to the parties and DBI.
Permit representatives and Planning staff described revised consolidated plans delivered shortly before the hearing that, planning said, appeared to comply with code for the roof‑deck permit. DBI and the architect explained the scope of work and confirmed foundation inspections had been performed and that revised drawings could be dated and incorporated into a special‑conditions permit.
The board’s action (rolled into a single motion) upheld Permit 6A as issued and upheld Permit 6B with revised plans dated 02/2013 and the five enumerated conditions (fence replacement to prior chain‑link condition at the appellant/permit‑holder boundary, a permanent valley gutter and rainwater leader into the permit holder’s drain, replacement of the third‑floor exterior door with a code‑compliant egress window, delivery of the foundation inspection report to DBI and parties, and the deck set back three feet from the appellant’s property line). The motion passed 4–0.
