DBI and planning staff discussed the options available: deny the permit so the sponsor could resubmit corrected plans, accept revised plans in the record tonight, or require the 10‑day notice and process the revision.
The board agreed the permit on file was defective for multiple reasons and voted to grant the appeal and revoke the permit, adding two express findings: (1) the permit is not code‑compliant; and (2) the one‑year bar on resubmitting the same permit scope does not apply in this case. The revocation was recorded as a 4–0 vote.
The board noted the permit holder may resubmit corrected plans and the planning department described the procedural paths for notice and any discretionary review that may follow.
