Neighbors agreed to support a future permit application for a smaller, four-foot projecting balcony off the kitchen level; the agreement stated that the balcony that prompted the appeal will not be proposed again under current ownership.
Because the parties withdrew the appeal, the board did not act on the merits. The stipulations were entered into the record and the withdrawal was acknowledged by the board.
