Joseph Duffy, Senior Building Inspector, reported that his July 23 site inspection found code concerns primarily related to access — a door opening over steps from a garage that does not provide a level landing and therefore does not meet code — plus alleyway step issues. Duffy said the interior conditions otherwise met basic code requirements but that conversion to a lawful unit would be difficult without design changes.
Jim Fay, counsel for the appellant Inga Dillon, told the Board he did not hear any life‑threatening hazards identified in the DBI inspection and said the appellant has been applying for housing but remains on waiting lists. Jonathan Witherington, the permit holder, said the cost to bring all three units on the property up to code would be prohibitive and that he is willing to work with the tenant but wants clarity about the permit’s status.
Members discussed whether to postpone further or set a fixed timeframe to report progress. The Board voted to continue the matter to Nov. 7, 2012, and authorized a three‑page brief from parties (with unlimited exhibits) documenting housing‑search efforts and other progress prior to the continued hearing. The motion passed 4–0.
