Board of Appeals continues rehearing for 69 Montezuma to Oct. 10 to allow settlement talks

The San Francisco Board of Appeals on Aug. 15 agreed to continue a rehearing request in the matter of Buskovich v. Department of Building Inspection concerning 69 Montezuma Street to Oct. 10. Attorney Andrew Zacks, representing the property interests, told the board the parties are engaged in ongoing settlement discussions and jointly requested more time.
Scott Sanchez, the Planning Department’s representative, said the department supports the parties’ request for rescheduling to allow further review and negotiation. Public commenter Elizabeth Cretara urged a September date; the parties and board members settled on Oct. 10 to allow sufficient time for discussions and calendar availability.
Vice President Frank Fung moved to continue the rehearing and the roll call produced three affirmative votes; the board recorded the action as a continuance to Oct. 10, 2012. The board noted that Commissioner Lazarus had reviewed the original hearing video and was prepared to participate in the rescheduled matter.
No substantive decision on the underlying appeal was made; the continuance preserves the parties’ ability to pursue settlement or return for full briefing on the rehearing date.
