Project counsel said the approval included a standard three‑year requirement to obtain building permits. The sponsor recently submitted a building permit; staff reported uncertainty about whether an extension required Commission action. Counsel said the zoning administrator previously issued a 1994 letter stating entitlements remain in effect until they are expressly revoked at a noticed public hearing and urged the Commission to confirm that the permit may be signed off.
Members of the public and practitioners supported bringing the matter before the Commission for transparency. Attorney Sue Hester, who represented the Alliance Francaise in the project’s original review, said she supported the Commission hearing and that the current presentation was an appropriate way to update the public.
Commissioners expressed general support for allowing the project to proceed, noting the sponsor has completed substantial work with the building department over several years and that case law and earlier zoning‑administrator guidance limit revocation of entitlements based solely on construction timing. Commissioners indicated they expect the zoning administrator to use judgment about when unusual circumstances warrant formal Commission review of an entitlement.
