Board upholds permit at 1100 Lombard with condition that tenants need not vacate during work

The San Francisco Board of Appeals voted unanimously on Oct. 26 to uphold a Department of Building Inspection permit for work at 1100 Lombard Street on the condition that tenants affected by the project not be required to vacate their units during construction.
Appellant counsel Steve Collier said negotiations with the permit holder produced an agreement under which the permit holder will place conditions on the permit so the tenants can remain in occupancy and will pay any additional expenses necessary to perform work with tenants in place. A tenants’ representative asked the board to remove the suspension and allow work to continue under that condition.
DBI and other staff confirmed the permit holder indicated willingness to accept the voluntary condition; commissioners framed the motion as granting the appeal and imposing the condition based on the voluntary agreement between the permit holder and the appellants. The board voted 4–0 to grant the appeal and impose the tenant‑protection condition.
What happens next: work may proceed under the permit with the voluntary condition; DBI retains inspection authority to ensure safety and code compliance while work occurs with occupants in place.
