Board overturns MTA denial and grants taxi medallion to driver

The San Francisco Board of Appeals voted unanimously on Aug. 10 to overturn the Municipal Transportation Agency’s denial and issue a taxi medallion to an applicant who demonstrated he met the current driving requirements.
Counsel for the appellant told the Board the driver had driven full time since February 2008 and presented records showing compliance with the present four‑out‑of‑five‑years standard. Jarvis Murray, enforcement legal affairs manager for SFMTA Taxi Services, said that while the applicant would not have qualified at the time his application first appeared on the wait list, the agency would not oppose the Board applying the current standard for this particular case.
Several commissioners noted the case had been pending for years and that the appellant had demonstrated continued driving and service to the public; the Board concluded the driver met the current standard and granted the appeal, adopting the medallion with written findings to follow.
The Board instructed staff to prepare findings and schedule adoption. The decision does not change SFMTA standards but resolves this applicant’s eligibility under present criteria.
