Board continues USF sidewalk-encroachment case to allow settlement talks with DPW
Summary

The Board of Appeals on May 25 continued a dispute over a minor sidewalk encroachment on Golden Gate Avenue involving the University of San Francisco and nearby residents.
USF counsel Harry O'Brien and appellant Richard Rabbit said the parties have an agreement in principle that requires Department of Public Works arborist input on tree impacts and any adjustments to the fence and retaining wall. John Kwon of DPW said the department typically reissues a minor encroachment permit to reflect an agreed reduction in encroachment and agreed to coordinate with the urban forester and parties to evaluate impacts and, if appropriate, issue a new permit.
Neighbors who participated in the settlement talks and additional nearby residents spoke in favor of continuing the matter to permit neighborhood negotiations. The board voted 5–0 to continue the case to June 29, 2011, to allow the parties and DPW to finalize a settlement and technical review by DPW staff.
