Commissioner Frank Fung moved to support the permit on four conditions the board read into the record: (1) the finished elevation of the ground floor must be no higher than about 395–396 feet above sea level as measured on an agreed survey, (2) all future addenda must be measured against the site permit drawings approved by DBI (date of issuance noted as March 29, 2010), (3) the rear wall at grade will be treated as a retaining wall with no space behind it, and (4) the garage opening shall be limited to 12 feet with a 10‑foot curb cut as shown on the site permit drawings. The board also noted that DBI and Planning must coordinate review of any addenda to ensure compliance with the site permit.
Scott Sanchez of the Planning Department told the board that the addenda review and Department of Public Works referrals already flagged risks regarding wider curb cuts and grading; the board’s conditions are intended to give the Planning Department greater leverage to enforce the original approved site plan if addenda are later proposed.
What’s next: The permit stands with the board’s conditions. The board said permit holders must supply the specified site permit documents and the finished ground floor elevation before further addenda or revisions are considered.
