Board upholds findings against P & S Towing after contested appeal

The San Francisco Board of Appeals on Sept. 15 adopted revised findings upholding the denial and potential revocation of P & S Towing’s permit for operations at 220 Rankin Avenue, concluding that material facts presented to the board supported the department’s earlier action.
Anne Feldon read a prepared statement from Peter Koehler of P & S Towing, saying the company’s ‘‘permit to operate should never have been denied or revoked’’ and that the San Francisco Police Department had circulated false information to customers before a March hearing. Sergeant William Coggan of the SFPD’s Permit Section replied that the SFPD’s records and later events between the agency hearing and the board’s de novo review were admissible and supported enforcement action. "The permittee operated his tow firm illegally and intentionally without a permit, intentionally charging excessive fees," Coggan said in his remarks.
Board members debated whether new material that arose after the police hearing but before the board’s hearing could be considered. Several commissioners noted the board’s review is de novo and that facts arising between hearings may be pertinent. The board made minor technical revisions to the proposed findings and voted to adopt them.
The action concludes the board’s formal review of the matter for now by recording the board’s findings; the adopted language notes P & S Towing’s conduct may constitute grounds for revocation. No additional relief or rehearing was granted at the meeting.
