Two related appeals concerning work at 1130 Cole were resolved at the May 19 Board meeting after the parties engaged in settlement discussions and the permit holder agreed to corrective conditions. Commissioners circulated a list of specific remedies (prepared by Commissioner Fung) that addressed fence repairs, light mitigation and other corrective measures.
Permit holder counsel said his client would perform the work and proposed the permit suspension be lifted once DBI signed off on the remedial items. Neighbor representatives welcomed the list but pressed that certain fence faces be sheathed to restore the prior appearance and asked that the permit holder not personally perform work on neighbors’ properties to avoid confrontations.
The Board approved the permit on condition that the permit holder’s team perform the corrective work, that the exposed face of the fence adjoining Ms. Ali’s property be sheathed to match the prior condition, and that final acceptance be by DBI inspection. The motion included a restriction that the permit holder not personally enter neighbor properties to do the corrective work; the permit remains upheld subject to completion of the required tasks and DBI signoff (vote 5‑0).
