Commission approves narrow time extension for 399 Fremont entitlements over objections

The Planning Commission voted 4 to 3 to grant a time-extension of entitlements for the 399 Fremont project in the Rincon Hill area, after a lengthy exchange over whether the materials before the commission described substantive project changes.

Deputy City Attorney Marlena Byrne and staff told commissioners that the only item legally before the commission at this hearing was the extension of the entitlement performance period beyond the 24 months required by code. Project sponsor representatives (Fifield Companies) and counsel argued the extension was essential to maintain lender confidence after market shifts and to allow time to reconfigure the approvals as a rental project.

Public commenters, notably Sue Hester, argued the packet contained material modifications (unit count, parking, design) and that the notice language was insufficient; commissioners pressed staff to clarify the limited scope of today's vote. Staff indicated minor modifications (units from 432 to about 452, increased bicycle parking, reduced parking) that fall within the commission's policy on substantial conformity. After debate, the commission approved an extension for the performance period from June 16, 2008 through June 15, 2009. The motion passed 4 to 3 (Antonini, Borden, Lee, Seguaya yes; Moore, Miguel, Olague no).

Deputy City Attorney Byrne advised the commission not to add monitoring conditions beyond the time extension; staff agreed to excise extraneous previously approved conditions from the adopted motion's text. The approval is limited to the time extension; any future design or entitlement changes must return to the commission as required by code.
