Commission approves conditional use to legalize Sweet Delight Cafe at 331 Clement Street

The Planning Commission unanimously approved a conditional use authorization for Sweet Delight Cafe at 331 Clement Street, allowing the existing self-service restaurant to be legalized under the planning code's formula-retail provisions.

Planning staff (Sharon Young) presented the project as a request under section 703.4 and related code provisions to formalize the use of the site as a self-service, Asian-fusion cafe. Staff's preliminary recommendation was for approval with conditions; the presentation noted the cafe has been operating on the block since April 2007, employs about 15 people, and that the applicant submitted petitions supporting the project.

Owner Jason Wu told the commission the business uses Quickly-branded products and signage that created confusion about franchise status but said Sweet Delight is independently owned and has community support. Commissioners questioned why a conditional use was not sought earlier; staff and the owner explained enforcement and signage factors. After questioning and brief public comment (none opposed), a motion to approve carried unanimously.

Commissioners directed staff to ensure the conditions and required documentation are reflected in the final resolution; the approval will allow the business to continue operating as a legalized formal retail use under the planning code.
