Board continues Mason Street illegal-unit matter for one year

Shufen (Sue) Fan Wu and Yuping Mei asked the Board of Appeals to continue their occupancy while an appeal over an alleged illegal unit at 1734–1740 Mason Street remains pending. The board heard a brief status report from William Quan, agent for the permit holder, who said the tenants have remained in place and supported their continued occupancy.
Department of Building Inspection staff noted a notice of violation and subsequent permit activity; DBI said life-safety issues were the board’s principal concern and suggested the permit could be reinstated and corrections made per the issued permit or that a legalization permit be pursued if feasible. Board members discussed whether the matter should be continued annually or set to the call of the chair and whether continuing annually imposed an unnecessary burden. The city attorney advised that the permit cannot be legalized under zoning because of the unit configuration and that continuing it in abeyance allows monitoring.
After deliberation President Frank Fung moved to continue the matter for one year and to request status reports from the landlord or agent; the motion passed on a 5–0 roll call. The board directed staff to send calendar notices for July 2010 and to inform parties of the continued status.
