The Board of Appeals denied a rehearing request by counsel for Driss Kiki Elasali challenging an earlier revocation of an A card (appeal O8-190). Attorney Leah Parmenter urged a rehearing, arguing new evidence showed disparate treatment compared with another driver; she said the appellant—s revocation stemmed from minor, nonmoving infractions compounded by prejudicial presentation of broker allegations.
Jordana Thigpen of the SFMTA Enforcement and Legal Affairs office told the board there was no new evidence warranting rehearing and that the board—s prior decision relied on substantial evidence that the appellant repeatedly violated rules, made false statements and drove during suspension. After brief commissioner discussion the board voted 5-0 to deny the rehearing request. A notice of decision and order will issue.
